Terms & Conditions

Last updated: September 19, 2026

These Terms & Conditions govern your
access to and use of TattooClients.com and any services, software, systems, consulting, implementation, advertising support, CRM access, automations, or related services provided by Brosway Inc. under the TattooClients brand.

1. Agreement to These Terms

These Terms & Conditions (“Terms”) constitute a binding agreement between you or the business you represent (“Client,” “you,” or “your”) and Brosway Inc., doing business as TattooClients (“TattooClients,” “we,” “us,” or “our”).

By accessing TattooClients.com, submitting an application, purchasing a service, signing an order form or service agreement, creating an account, authorizing payment, or using TattooClients services, you acknowledge that you have read, understood, and agreed to these Terms.

If you are accepting these Terms on behalf of a company, studio, partnership, or other organization, you represent that you have authority to bind that organization.

2. TattooClients Services

TattooClients provides client acquisition, implementation, technology, CRM, automation, advertising support, consulting, and related services designed primarily for tattoo artists and tattoo studios.

Depending on the service or plan purchased, services may include some or all of the following:

• Client acquisition strategy and implementation;

• Lead generation and Meta advertising setup, management, testing, or optimization

• Landing page creation (seperately) , forms, calendars, consultation booking systems, and lead capture infrastructure;
• CRM and sales pipeline configuration
• Automated email, SMS, appointment reminder, and follow-up workflows;

• consultation, deposit, payment, and booking process configuration;

• reporting, tracking, integrations, and attribution infrastructure;

• scripts, templates, processes, training, recommendations, and consulting;

• ongoing access to applicable TattooClients software, CRM, workflows, and system features; and
• optional upgrades, add-ons, additional services, or third-party integrations.

The exact scope of a Client’s services is determined by the proposal, checkout page, invoice, order form, service agreement, plan description, or other written offer accepted by the Client.

3. Initial 90-Day Service Period

Unless a different period is expressly stated in writing, the initial TattooClients hands-on implementation program is provided for a ninety (90) day service period.

Enrollment in the initial program constitutes a commitment to the full 90-day service period and to the payment obligations accepted at enrollment. A Client’s decision to stop participating, pause advertising, discontinue their tattoo business, stop responding to leads, or otherwise cease using the services does not by itself terminate payment obligations already agreed to, except where required by applicable law or expressly agreed by TattooClients in writing.

The 90-day period is intended to provide time for implementation, testing, optimization, data collection, follow-up, and refinement. Client acknowledges that marketing and client acquisition systems require active participation, testing, and reasonable time to evaluate.

4. What Happens After the Initial 90 Days

Unless otherwise stated in the Client’s order or agreement, the hands-on implementation portion of the initial program concludes after the 90-day service period.

Following the initial period, the Client may continue using applicable TattooClients CRM, pipeline, contact database, automations, workflows, and other platform features through an ongoing paid subscription.

The ongoing subscription is separate from the initial hands-on implementation service. Unless specifically included in the Client’s continuing plan, ongoing CRM access does not include the same level of advertising management, consulting, campaign creation, creative production, optimization, or hands-on implementation provided during the initial program.

Clients may be offered upgrades, expanded plans, additional users, phone numbers, communication usage, advertising management, integrations, automation services, consulting, or other add-ons for additional fees.

5. Client Data and Pipeline

Subject to these Terms and payment of all amounts due, the Client retains ownership of the Client’s underlying business data, including the Client’s customer and prospect contact information submitted to or generated through the Client’s account.

While an applicable subscription remains active, the Client may continue accessing its data and pipeline through the TattooClients platform, subject to system functionality, third-party provider availability, usage limits, and the Client’s selected plan.

TattooClients retains all ownership rights in its proprietary systems, platform configuration, processes, methods, templates, workflows, automation architecture, copy frameworks, training materials, strategies, documentation, designs, know-how, and other intellectual property, except for Client-owned materials and data.

Cancellation or termination of an account may result in loss of platform access. Clients are responsible for exporting information they wish to retain before account access ends. TattooClients may retain or delete information in accordance with its Privacy Policy, contractual obligations, legal requirements, backup practices, and legitimate business needs.

6. Fees and Payment

Current fees are presented through the applicable proposal, checkout page, invoice, order form, service agreement, subscription page, or other purchase documentation. Prices are intentionally not incorporated into these general Terms and may vary by plan, promotion, service scope, usage, upgrade, or add-on.

By purchasing a service, Client authorizes TattooClients and its payment processors to charge the payment method provided according to the payment schedule disclosed at purchase.

If TattooClients offers an installment payment option, the total amount payable through installments may be higher than the amount charged under a pay-in-full option. The applicable total, installment schedule, and payment terms will be disclosed before the Client accepts the installment arrangement.

Unless expressly stated otherwise, advertising spend, Meta charges, carrier/SMS usage, third-party software, domains, integrations, premium features, and other third-party costs are separate from TattooClients service fees.

7. Recurring Subscription and Automatic Renewal

If the Client enrolls in or continues with a recurring TattooClients subscription, the subscription will automatically renew at the applicable billing interval until canceled in accordance with these Terms and the purchase terms presented to the Client.

By enrolling in a recurring subscription, Client authorizes TattooClients to charge the payment method on file for recurring subscription fees and any authorized usage-based charges, upgrades, or add-ons.

Subscription pricing, features, and plan structures may change. Where required, TattooClients will provide applicable notice before a material pricing change takes effect for an existing recurring subscription.

8. Cancellation of Ongoing Subscription

A Client may request cancellation of an ongoing subscription using the cancellation method communicated by TattooClients or by contacting [email protected].

Unless otherwise required by law or stated in writing, cancellation prevents future renewals and does not retroactively refund charges already processed. Access may remain available through the end of the already-paid billing period unless the account is terminated earlier for breach, misuse, nonpayment, or another permitted reason.

Cancellation of an ongoing subscription after the initial service period does not retroactively cancel or refund the initial 90-day program.

9. Initial Cancellation Window

Unless different cancellation rights are required by applicable law or expressly stated in a signed agreement, a Client may request cancellation within twenty-four (24) hours of the initial purchase, provided TattooClients has not already materially commenced onboarding, account configuration, strategy work, campaign preparation, CRM setup, automation work, creative preparation, or other customized services for the Client.

Once the cancellation period has expired or customized work has materially commenced, payments are generally non-refundable except where required by applicable law or an express written guarantee applies.

10. Refund Policy and Client Participation

TattooClients provides services, systems, implementation, strategy, technology, and support. Results depend on numerous factors outside TattooClients’ control, including Client participation, pricing, portfolio quality, location, reputation, offer, demand, response speed, sales ability, advertising budget, creative assets, market conditions, and third-party platform performance.

After the applicable cancellation period, a change of mind does not create a right to a refund.

Unless required by law or expressly provided by a separate written guarantee, a Client is not entitled to a refund merely because expected results were not achieved, particularly where the Client did not reasonably participate in, implement, or test the methods and processes provided.

Client participation may include, as applicable:

• Providing accurate business information, offers, pricing, portfolio material, photos, videos, branding, and requested assets;
• providing necessary access to advertising accounts, social media accounts, calendars, websites, domains, payment systems, and other required services;
• maintaining agreed advertising budgets and active payment methods;
• responding to leads and prospective clients in a timely and professional manner;
• attending scheduled strategy, onboarding, or support calls;
• using the CRM, pipeline, follow-up systems, consultation process, and other systems as instructed;
• following reasonable recommendations and allowing reasonable testing of campaigns, creatives, audiences, offers, and follow-up methods; and
• providing timely approvals, feedback, and information necessary for implementation.

Failure to participate, failure to respond to leads, refusal to test recommended methods, failure to provide assets or access, stopping campaigns prematurely, or discontinuing use of the system does not establish that TattooClients failed to provide the contracted services.

11. No Guarantee of Specific Business Results

TattooClients does not guarantee any specific number of leads, consultations, bookings, tattoo clients, deposits, sales, revenue, return on advertising spend, profit, or other financial result unless a specific written guarantee is expressly included in the Client’s signed agreement.

Advertising and marketing involve risk and uncertainty. Past results, examples, case studies, testimonials, projections, and performance from TattooClients or other clients are illustrative and do not guarantee future performance.

TattooClients does not control whether a prospective customer responds, attends a consultation, pays a deposit, purchases a tattoo, cancels, requests a refund, or becomes a repeat customer.

12. Advertising Accounts and Third-Party Platforms

TattooClients may use or integrate with third-party platforms such as Meta, Instagram, Facebook, Google, payment processors, calendar providers, email providers, telecommunications providers, CRM infrastructure, automation services, and other technology vendors.

These third parties operate independently and may change their products, APIs, policies, algorithms, pricing, approval requirements, account restrictions, or availability without TattooClients’ control.

TattooClients is not responsible for third-party outages, account suspensions, advertising disapprovals, platform restrictions, algorithm changes, payment processor holds, messaging carrier filtering, or other actions taken by third-party providers, except to the extent liability cannot legally be excluded.

13. Client Advertising and Content Responsibilities

Client is responsible for the legality, accuracy, ownership, and authorization of content, claims, photos, videos, trademarks, customer lists, offers, pricing, promotions, and other materials supplied to TattooClients.

Client must not provide content that infringes intellectual property, violates privacy or publicity rights, contains unlawful claims, or violates applicable advertising or platform rules.

Client remains responsible for its tattoo services, customer experience, licensing, health and safety obligations, taxes, business operations, refunds to its own customers, and compliance with laws applicable to its tattoo business.

14. Email, SMS and Communications Compliance

Where TattooClients provides email, SMS, phone, or automated communication functionality, Client is responsible for using those features lawfully and only contacting individuals where an appropriate legal basis or consent exists.

Client must honor opt-out requests and comply with applicable marketing, privacy, telecommunications, anti-spam, and consumer protection laws. TattooClients may suspend messaging functionality where it reasonably believes a Client’s use creates compliance, deliverability, carrier, or platform risk.

SMS Terms & Conditions

Brosway Inc. (TattooClients) may send SMS messages to users who have provided the applicable consent. Messages may include consultation confirmations, appointment reminders, scheduling and rescheduling updates, meeting information, and other service-related communications. Users who separately consent to marketing messages may also receive promotional messages, special offers, service updates, and other marketing communications.

Message frequency varies. Message and data rates may apply. You may opt out of SMS messages at any time by replying STOP. For assistance, reply HELP or contact TattooClients using the contact information provided in these Terms.

Carriers are not liable for delayed or undelivered messages.

You must be at least 18 years old to participate in the TattooClients SMS messaging program.

15. Confidentiality

Each party may receive confidential or proprietary information from the other. Each party agrees to use reasonable measures to protect such information and not disclose it except as necessary to perform the services, operate the business relationship, comply with law, or as otherwise authorized.

TattooClients confidential information includes non-public strategies, systems, processes, templates, scripts, training, workflows, automation logic, pricing structures, technical configurations, methodologies, documentation, and business know-how.

Additional confidentiality obligations may be established through a separate nondisclosure agreement or Client Service Agreement.

16. Intellectual Property

TattooClients and its licensors retain all rights, title, and interest in TattooClients technology and intellectual property. No ownership of TattooClients intellectual property is transferred to the Client merely because it is configured or used within the Client’s account.

Subject to an active account and compliance with these Terms, TattooClients grants Client a limited, non-exclusive, non-transferable, revocable right to use applicable platform features and materials solely for the Client’s internal business operations.

Client may not copy, resell, sublicense, reverse engineer, reproduce, distribute, publish, disclose, or commercially exploit TattooClients proprietary systems, templates, workflows, training, or methodologies except with prior written authorization.

17. Account Security

Client is responsible for safeguarding usernames, passwords, authentication methods, and account access. Client must promptly notify TattooClients of suspected unauthorized access or security incidents involving its TattooClients account.

18. Suspension and Termination

TattooClients may suspend or terminate services for material breach, nonpayment, fraud, abusive behavior, unlawful activity, platform misuse, security threats, infringement, messaging abuse, or conduct that creates material legal, technical, reputational, or third-party platform risk.

Termination does not eliminate payment obligations accrued before termination or amounts otherwise due under an agreed service commitment, subject to applicable law.

19. Disclaimers

To the maximum extent permitted by law, TattooClients services are provided on an “as is” and “as available” basis. TattooClients disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the services will be uninterrupted, error-free, or produce a particular commercial result.

20. Limitation of Liability

To the maximum extent permitted by applicable law, Brosway Inc., TattooClients, and their owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business opportunities, loss of goodwill, loss of data, or advertising losses arising from or related to the services.

To the maximum extent permitted by applicable law, the aggregate liability of TattooClients arising out of or relating to the services will not exceed the amount actually paid by the Client to TattooClients for the specific service giving rise to the claim during the applicable period stated in the Client agreement, or, if no period is stated, during the three months preceding the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

21. Indemnification

To the extent permitted by law, Client agrees to defend, indemnify, and hold harmless Brosway Inc., TattooClients, and their officers, employees, contractors, and affiliates from third-party claims, losses, liabilities, damages, and reasonable costs arising from Client-provided content, Client’s tattoo services, Client’s unlawful use of the platform, Client’s violation of applicable law, or Client’s infringement of another party’s rights.

22. Changes to Services and Terms

TattooClients may update its services, features, integrations, and these Terms from time to time. Updated Terms will be posted with a revised “Last updated” date. Where legally required, TattooClients will provide additional notice or obtain consent before changes materially affecting an existing contractual relationship take effect.

23. Governing Law and Disputes

These Terms and any dispute arising from them will be governed by the law specified in the applicable Client Service Agreement. If no separate governing-law provision has been agreed, the governing law and forum will be determined in accordance with applicable law and the principal place of business of Brosway Inc.

Before initiating formal proceedings, the parties agree to make a good-faith attempt to resolve the dispute directly, unless immediate legal relief is reasonably necessary or such a requirement is prohibited by law.

24. Electronic Communications and Signatures

Client agrees that electronic acceptance, electronic signatures, checkbox acceptance, online checkout, payment authorization, and electronic records may be used in connection with TattooClients services to the extent permitted by law.

25. Severability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the maximum extent permitted by law. A failure to enforce a provision on one occasion does not waive the right to enforce it later.

26. Entire Agreement and Order of Precedence

These Terms, together with the Privacy Policy and any applicable signed Client Service Agreement, proposal, order form, checkout terms, or written service-specific terms, constitute the agreement governing the applicable services.

If a signed Client Service Agreement expressly conflicts with these general Terms, the signed Client Service Agreement controls with respect to that conflict.
